Govee "#LitByGovee" Campaign - Official Terms & Conditions

We're delighted you're considering participating in Govee's #LitByGovee User-Generated Content Campaign! This is your chance to showcase your creativity, win awesome prizes, and even potentially see your work featured by Govee!

These Terms outline the campaign's guidelines to ensure a fair, creative, and rewarding experience for all participants. Please read them carefully before submitting your content.

  1. Participation Agreement
    By entering this Govee User-Generated Content Campaign (together, the “UGC”,"Campaign"), you ("Participant") acknowledge that you have read, understood, and agree to be bound by these Official Terms & Conditions. Your participation constitutes full acceptance of all rules, requirements, and judging criteria outlined herein. We encourage you to create with enthusiasm while respecting these guidelines that help maintain the integrity of the Campaign for all involved.
  2. Eligibility Requirements
    This exciting opportunity is open to creative individuals who are at least 18 years of age at the time of entry and have the legal capacity to enter into this agreement. Unfortunately, employees of Govee Technology Co., its subsidiaries, affiliates, advertising/promotion agencies, and immediate family members are not eligible to participate. We must also comply with local laws, so participation may be void where prohibited or restricted by applicable legislation.
  3. Submission Requirements & Content Guidelines
    We're looking for original, high-quality content that showcases your creativity with Govee products. All submissions must be your own authentic work, previously unpublished, and not entered in other competitions or events (not including events and giveaways directly related to the #LitByGovee UGC Campaign). While we encourage bold expression, content must not contain any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable. We reserve the right to request reasonable modifications to ensure content meets our quality standards and aligns with our brand values.
  4. Submission Process & Deadlines
    The Campaign is intended to be ongoing until further notice. Govee reserves the right to modify, suspend, or terminate the campaign at any time at its sole discretion, with or without prior notice. To participate, you must submit your content through either direct messages to the official Govee social accounts on Meta (Instagram or Facebook) or by posting user-generated content to social platforms (Instagram, Facebook, X, TikTok, YouTube, Threads, Bluesky) using the hashtag #LitByGovee. 
  5. Winner Selection & Prize Details
    On a monthly basis, Govee will review all submitted entries and select a number of outstanding content to be featured on Govee's official website. The Participants entering the selected content (“Winners”) will be duly credited and notified via direct message. Winners will be entitled to receive one Govee lighting product ("Prize"). The specific Prize shall be determined through mutual agreement, taking into consideration the availability of product inventory at the time of notification. Govee reserves the right to make the final decision regarding Prize selection and distribution. All Prizes are non-transferable and may not be exchanged for cash alternatives. Taxes and other potential fees associated with Prize acceptance are the sole responsibility of the Winners.
  6. Intellectual Property Rights
    By entering this Campaign you grant Govee a comprehensive, irrevocable, perpetual, non-exclusive, sublicensable, worldwide, royalty-free license for any and all purposes to use, copy, exhibit, reproduce, modify, adapt, publish, display, distribute, and otherwise exploit your content in any media formats now known or later developed. This includes but is not limited to marketing, social media, product packaging, promoting and advertising and other promotional activities of the Govee brand, products and services, testing of Govee’s technologies, monetization of content through advertising, subscription, licensing and other means. Such a license further includes, among other things, the right for Govee to incorporate the UGC in video or audio visual content, text, graphics, artwork, photographs, templates, and other content or materials created by or on behalf of Govee or its licensees (the “Govee Network”) to create what is referred to herein as the "Govee Network Materials." We may create derivative works from your submission while ensuring proper attribution where appropriate. Govee acknowledges and agrees that You retain all right, title and interest in and to the UGC and Appearances, including all intellectual property rights, rights of publicity or privacy and moral rights therein, other than those rights granted herein.
  7. Participant Representations & Warranties
    By submitting content, you affirm that: (1) you are the sole creator and owner of all rights to the submitted work, including all intellectual property rights, rights of publicity or privacy, and moral rights therein; (2) you have obtained all necessary permissions for any third-partywhose material is included in the content, including but not limited to the real names, nicknames, likenesses, voices, live or recorded performances, autographs, photographs, biographical information of such third party individuals, and the owner of any music, images, video, audio, photos, text, or other material embedded within the User-Generated Content; (3) the content is your original creation and does not infringe any intellectual property rights or violate any laws, regulations, or rights of any third parties, including but not limited to copyrights, trademarks, patents, rights of publicity or privacy, moral rights, or any other proprietary rights; (4) you have all required rights to grant the licenses specified in these Terms; and (5) if your UGC contains photographs or digital or video images that depict a child under the age of majority in their state of residence, you have obtained written permission from the minor’s parent or guardian to provide the photo, digital, or video image for commercial use and any other use permitted under these Terms.
  8. Indeminity
    You will indemnify, defend and hold Govee harmless from and against any and all claims, demands, damages, liabilities, losses, costs and expenses (including reasonable attorneys’ fees) arising from or related to: (a) breach of any of Your representations and warranties in this Agreement; (b) any third party claim that the UGC or Appearances, or Govee’s use thereof, infringe, misappropriate or violate such third party’s intellectual property or other third party rights ; and (c) any third party claim that is based on any act or omission of You that results in personal injury, death, property damage or the violation of any law, ordinance or regulation.
  1. General Provisions & Event Administration
    Govee reserves the right to modify, suspend, or terminate the Campaign in the event of technical difficulties, fraud, or any other factors beyond our reasonable control that might compromise the fairness or integrity of the competition. We may update these Terms as needed, with material changes being communicated to participants when practical. Any attempt to deliberately damage or undermine the legitimate operation of this Event may result in disqualification and potential legal action.
  2. Governing Law & Dispute Resolution
    These Terms shall be governed by and construed in accordance with the US State of Illinois, without regard to its conflict of law principles. Any disputes arising from or relating to this Campaign shall be resolved exclusively in the courts of Illinois, United States, and participants consent to personal jurisdiction in such courts.
  3. Additional Terms
    By participating in the Campaign, Participant acknowledge that you participate at your own risk. Govee is not responsible for any physical harm, injury, death, or property damage that may occur as a result of your participation in any activities related to the Campaign. You agree not to engage in any dangerous, harmful, or illegal behavior while creating or submitting User-Generated Content. You are solely responsible for your safety and the legality of your actions during the Campaign. Govee disclaims all liability for risks associated with your participation, including but not limited to activities involving physical exertion, potentially hazardous situations, or the use of products in unsafe conditions.
